For a period of 24 months with effect from the date of delivery, the products delivered by the Vendor shall, to the exclusion of any other warranty, enjoy protection against any latent vice or material, design or manufacturing defect affecting the products delivered which renders them unfit for their intended use.

No warranty shall be provided in case of improper use, product modification, negligence or lack of maintenance on the part of the Buyer, or in cases of normal wear and tear of force majeure.

In order to exercise its rights, the Buyer shall on pain of forfeiture of any related action, inform the Vendor in writing of the existence of any such vices and provide the necessary supporting documentation within 30 days of the date of their discovery.

The Vendor’s warranty is limited to the simple replacement of the warranted products adjudged to be defective. The Vendor shall not be required to provide any other type of indemnification or compensation, notably but not exclusively compensatory damages.

Limit of liability

The Vendor shall be liable to provide compensation for the pecuniary consequences of losses suffered only when they are both (i) direct and (ii) foreseeable given the nature of the products.

Under no circumstances shall it be held liable for any indirect or unforeseeable loss or damage including notably, but not exclusively, any loss of earnings, loss, inaccuracy or corruption of files or data, commercial damage, loss of sales or profits, loss of clients, loss of opportunity or cost of obtaining a replacement product or technology in relation to or arising from a product or its operation.

In any event, the amount of the Vendor’s pecuniary liability resulting from the use or the level of performance of the product is limited to the reimbursement of the amount of the sums actually paid by the Buyer to the Vendor.

This page states the terms and conditions of the commercial warranty (the “Warranty”) granted to professional end-users. This Warranty shall apply only if the product has been registered, i.e. if the professional end-user has completed the “Product Registration Form” at warranty.sauermanngroup.com within 30 days of purchase from an authorized Sauermann dealer.

For the purpose of this Warranty, a “professional end-user” is defined as a natural or legal person using the Sauermann product for commercial, industrial, professional or trade purposes, and who is able to provide evidence of ownership by proof of purchase. The Warranty does not cover products used as part of a rental agreement.

Products covered by the Warranty

The Warranty shall cover the following Sauermann products, to the exclusion of all other products:

Warranty period

The Warranty shall apply for a period of 12 months, commencing on the earliest of the following dates:

· Upon the expiry of the statutory warranty granted by the authorized Sauermann dealer from which the professional end-user purchased the product (if any), or

· Two (2) years after the date on which the professional end-user purchased the product from an authorized Sauermann dealer.

What this Warranty covers

To the exclusion of any other warranty, the registered product covered by a Sauermann Warranty shall be protected against hidden defects, or material, design or manufacturing defects, rendering the registered product unfit for its intended use.

The Sauermann Warranty shall be limited to the repair or simple replacement of the defective product covered by the Warranty. Sauermann shall not be required to provide any other form of indemnity or compensation, including but not limited to compensatory damages.

The professional end-user shall remain liable for any shipping or transportation costs necessary to execute the Warranty.

The Warranty shall apply only in the country in which the registered product was purchased.

Exclusions and/or limitations of liability

The Warranty shall not apply in case of improper use, negligence, accident, lack of supervision or maintenance, repair performed by any person not authorized by Sauermann Group, normal wear and tear, or force majeure.

The Warranty shall not cover the replacement of consumables (such as batteries) or normally worn parts.

Sauermann makes no guarantee that the sold products are suited to the specific requirements of the professional end-user’s activity. The professional end-user hereby declares that he/she is familiar with the technical features of the products and has duly selected and settled on the ordered products in accordance with his/her identified needs, under his/her sole responsibility. As such, Sauermann makes no implied warranty of merchantability or fitness for purpose.

Sauermann shall therefore not be required to compensate the professional end-user or third parties for the consequences arising from the use of the products, including direct or indirect damage, personal injury, damage to goods other than the sold products, loss of profits, loss of earnings, damage resulting from deterioration, or loss of data by the professional end-user.

The repair or replacement of the product shall not have the effect of extending the Warranty period.

All software – whether built into the products or sold separately – shall remain the property of Sauermann. The professional end-user shall benefit exclusively from an end-user licence as granted by the publisher.

How to obtain Warranty service

In order to exercise his/her rights under this Warranty, the professional end-user shall inform Sauermann in writing of the existence of any defects, along with the necessary supporting documentation, within 30 days of discovering such defects. Failing that, the professional end-user shall lose his/her rights under this Warranty. The professional end-user shall also provide proof of purchase from an authorized dealer, including the date of purchase, the dealer’s name, and the model name or product code.

Nothing in this Warranty shall affect such other rights, including those granted to the professional end-user under national legislation governing the sale of goods that cannot be waived or limited by contract.
